Terms of service

These terms govern your access to and use of the Foleo website and matching service (the Service), operated by Foleo Pty Ltd (Foleo, we, us). By using the Service you agree to these terms.

What Foleo is

Foleo is an independent referral and matching service. We help property buyers across Australia identify a small shortlist of independently vetted buyer's agents whose specialisation, track record and licensing align with the buyer's stated requirements. Foleo is not a party to any subsequent engagement between a buyer and a buyer's agent.

What Foleo is not

Foleo is not a licensed real estate agent, financial adviser, mortgage broker, conveyancer or legal practitioner. We do not provide personal financial product advice, real estate agency services, or any service that would require a credit licence. Buyer's agents matched through Foleo are independently licensed and operate under their own terms.

Referral fees

Foleo earns a referral fee from agents we introduce you to, paid only where an introduction leads to a paid engagement. This fee is paid by the agent and does not affect the rate the agent charges you.

How matches are made

Matches are generated using a combination of the information you provide and our own assessment of each agent's specialisation, track record and capacity. Match selection is editorial. We do not sell ranking or sponsored placement under any circumstance. We take reasonable care in selecting matches but make no warranty that any match will be the best possible fit, or that any introduction will lead to a successful purchase.

Your responsibilities

You agree to provide accurate and complete information when using the Service, to use the Service only for lawful personal purposes, and to conduct your own due diligence on any buyer's agent before engaging them. Decisions about whether to engage an agent, and the terms of that engagement, are yours alone.

Intellectual property

All content on the Service, including the Foleo name and brand, the matching framework and any associated written material, is owned by Foleo or its licensors and may not be reproduced, distributed or used without our written permission, except as needed to use the Service.

Disclaimer and limitation of liability

The Service is provided “as is” and “as available.” To the maximum extent permitted by law, Foleo excludes all warranties, conditions and representations not expressly set out in these terms.

Nothing in these terms limits any consumer guarantee or other right you have under the Australian Consumer Lawthat cannot lawfully be excluded. Where Foleo's liability can be limited, our total aggregate liability for any claim arising out of or in connection with the Service is limited to AUD$100.

Termination

You may stop using the Service at any time. We may suspend or terminate access if we believe you have breached these terms or used the Service in a way that is harmful to us or to other users.

Governing law

These terms are governed by the laws of New South Wales, Australia. The courts of New South Wales have exclusive jurisdiction over any dispute, subject to any non-excludable right you have to bring proceedings elsewhere.

Changes

We may update these terms from time to time. The version date above reflects the most recent update. Continued use of the Service after a change indicates your acceptance of the updated terms.
